Terms of Service

These Terms of Service ("Terms") govern your use of FOKiiS ("we", "us", "our"), a SaaS platform for photographers to manage galleries, client selections, payments, and delivery. By registering or using the service, you agree to these Terms.

1. Acceptance and eligibility

You must be at least 18 years old and have the legal capacity to enter into binding contracts. By creating an account, you represent that you meet these requirements and that all information you provide is accurate.

2. Account and security

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly of any unauthorised access or breach.

3. Use of the service

FOKiiS is intended for professional or semi-professional photographers to deliver galleries, collect client selections, process payments, and manage deliverables. You agree to:

• Use the service only for lawful purposes and in line with these Terms
• Not upload content that infringes others' rights, is defamatory, or violates applicable law
• Not resell, sublicense, or provide the service to third parties as a white-label product
• Comply with all applicable laws, including those in Nigeria where the service is offered

4. Payments, fees, and refunds

Subscription and usage fees are described on our pricing and billing pages. Payment processing for client transactions is handled via Paystack; our fees (e.g. platform fees) are disclosed before you complete a transaction. Refund requests are handled according to our refund policy and applicable payment-provider rules.

5. Your content and data

You retain ownership of your images and other content. You grant us the rights needed to operate the service (e.g. storing, displaying, and delivering content to your clients). We do not claim ownership of your work. Our use of personal data is described in our Privacy Policy.

6. Intellectual property

FOKiiS's branding, software, and materials are our property or our licensors'. You may not copy, modify, or reverse-engineer our service except as explicitly permitted.

7. Limitation of liability

To the fullest extent permitted by law, FOKiiS is provided "as is". We are not liable for indirect, incidental, special, or consequential damages, or for loss of revenue, data, or business. Our total liability shall not exceed the amount you paid us in the 12 months before the claim.

8. Termination

We may suspend or terminate your account for breach of these Terms or for operational, legal, or security reasons. You may close your account at any time via your account settings. On termination, your right to use the service ends; we may retain and use data as set out in our Privacy Policy.

9. Changes to the Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice in the product. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the service.

10. Governing law and disputes

These Terms are governed by the laws of Nigeria. Any dispute shall be subject to the exclusive jurisdiction of the Nigerian courts, unless otherwise required by law.
